Company held responsible for employees injury by vacuum

Ricardo Garcia reached into the hose of an industrial vacuum, trying to retrieve a piece of coal that was sucked into the machine. His arm got stuck in the hose, trapping Garcia’s arm due to the suction of the powerful vacuum.

Garcia claims he yelled for help but the Pneumatic Industrial Service employee running the vacuum did not respond in a timely manner to turn off the power of the vacuum. He claims that the company failed to properly warn him of the possible dangers of using the industrial vacuum.

Garcia’s injuries occurred at the Exxon Mobil Plant in Beaumont, Texas. He is suing for medical expenses, loss of earning capacity, physical pain, and mental distress.
