Kayla Carpenter was struck on the a feeder street of a major highway one night when she was attempting to cross. An oncoming motorist did not see her in the dark and she was left with injuries that would require her left leg to be amputated.

Carpenter is suing the Texas Department of Transportation and the city of Groves for not properly lighting the road. According to Carpenter she was crossing the feeder street when Derek West struck her with his vehicle because it was too dark to see her crossing. The suit does not indicate why Carpenter was crossing the street that night.

Carpenter is suing for medical expenses, loss of earning capacity, physical pain, disfigurement, impairment, and mental anguish.
