Dog Bite Victim Sues Animal Services

Posted on Thursday, January 31st, 2008 at 7:01 am

Dr. Nancy Matthews, an equine veterinarian in the San Diego area, has filed suit against the county Animal Services Department, alleging that it failed to protect the public from a pair of dangerous dogs which mauled her in November of 2006. According to the suit, the county failed to properly investigate previous attacks by the dogs in question. Animal Services contends that it did all that it was obligated to do while still respecting the rights of the dogs’ owner, Pedro Torres. Torres pleaded guilty to a felony and was sentenced to 90 days in jail and 4 years probation in connection with the attack, in a rare court decision.

Matthews is not satisfied with Torres’ conviction and maintains that the county ought to have imposed more restrictions on the dogs after the two previous attacks. She claims the attack has made her unable to practice her profession, since she is afraid of dogs on horse farms, as well as suffering from psychologically paralyzing flashbacks and chronic neck pain. She is seeking unspecified damages.

Teacher breaks student’s finger – Personal injury lawsuit is filed

Posted on Sunday, January 13th, 2008 at 4:01 pm

An 8 year old student’s finger was broken after a PE teacher allegedly threw a baseball to him at close range during class. Amy Bald, the mother of the student, has filed a lawsuit against Jack Bayers, the teacher. Bald claims that Bayers aggresive throw was the teacher’s way of getting revenge on the student after he dropped a catch. She is seeking $200,000 in damages on behalf of her son.

Bald also claims that Bayers failed to obtain medical attention for the student after he complained of pain and that he believed his finger was broken. She states that Bayer had a duty to not injure a student and to obtain medical attention if there was any question that a student was hurt. He failed to do both.

Rhonda Hughes has filed a personal injury lawsuit against a YMCA after she fell while roller skating. Hughes is seeking damages in excess of $50,000 after falling when out-of-control skaters crashed into her and caused her to fall. Hughes claims that the YMCA is responsible for monitoring the rink and should have done a better job of controlling the rowdy skaters.

Hughes claims that she sustained a fracture in her ankle due to being pushed by the unruly skaters. She is suing for medical expenses, disability, and pain and suffering. She also claims that the knee injury she also sustained has caused her permanent injury.
