Missouri Supreme Court overturns limit on medical malpractice suit damages

In a split 4-3 decision, the Supreme Court of the state of Missouri overturned a law that placed a $350,000 limit on the noneconomic damages a person can receive as a result of a medical malpractice lawsuit.

The now-overturned 2005 limit was put into effect to fight the rapid increase in the cost of malpractice insurance that was causing doctors to move away from Missouri.

The state’s high court determined that the law infringed on a jury’s “inviolable” power to assess facts and damages.
