When a personal injury lawsuit is filed, the case goes through a number of steps before it goes to court. The first step is typically the defendant receives notice of the filing. 

Once that occurs, the defendant will likely hire a lawyer who may want to settle the case out of court. If the case is settled out of court, then it will likely not go to trial. 

If the two sides are unable to settle the case, then the case may go to trial. However, other options may exist depending on the lawsuit in question.
