An 8 year old student’s finger was broken after a PE teacher allegedly threw a baseball to him at close range during class. Amy Bald, the mother of the student, has filed a lawsuit against Jack Bayers, the teacher. Bald claims that Bayers aggresive throw was the teacher’s way of getting revenge on the student after he dropped a catch. She is seeking $200,000 in damages on behalf of her son.
Bald also claims that Bayers failed to obtain medical attention for the student after he complained of pain and that he believed his finger was broken. She states that Bayer had a duty to not injure a student and to obtain medical attention if there was any question that a student was hurt. He failed to do both.
