Wisconsin's District IV Court of Appeals recently found a landlord not liable in a dog bite injury lawsuit that was filed by the parents of a boy who was bitten by a pit bull.
The incident occurred when the 7-year-old boy went to a neighbor's house. He was bitten by the neighbor's pit bull, which the lawsuit claimed was a vicious breed of dog that should not have been allowed to live in the house.
The boy's parents filed the lawsuit against the landlord because the dog bite occurred in one of his tenant's homes. However, the court found the landlord could not be held responsible for the injury because of a general liability rule which states that landlords are not responsible for animal attacks that occur on their property unless they are the owner of the animal
